Client – a natural person, a legal person, or an organizational unit that is not a legal person, whose specific provisions grant legal capacity and who places an Order within the Store
Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93 as amended)
Terms and Conditions – these Terms and Conditions for providing services electronically within the online store Clothesforcrews.com
Online Store (Store) – the website available at www.clothesforcrews.com, through which the Client may, in particular, place orders
Goods – products presented in the Online Store
Sales Agreement – a contract for the sale of Goods within the meaning of the Civil Code, concluded between UBIERAMYEKIPY DAMIAN TABACZUK and the Client, concluded via the Store's website
Consumer Rights Act – the Act of May 30, 2014 (Journal of Laws of 2014, item 827)
Act on the Provision of Electronic Services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204 as amended)
Order – the Client's declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of goods

Information about the goods provided on the Store's website, in particular, their descriptions, technical and usage parameters, and prices, constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code
The clothing presented in the online store as children's clothing is intended for children from 3 years of age and should be used under the supervision of an adult
III. Rules for Using the Online Store
Client has the possibility to make purchases in the Store by registering their Client account or without registration
Registration occurs by filling out and accepting the registration form available on one of the Store's pages
A condition for registration is acceptance of the Terms and the provision of personal data marked with an asterisk as mandatory. During registration, the Client may voluntarily provide their date of birth, which, if consent to the newsletter is given in accordance with point 3.8 of the Terms, is used solely for sending a special personalized offer on the occasion of their birthday

For the purpose of executing the sales agreement, both registered and unregistered Clients consent to the processing of the provided personal data. In the case of unregistered Clients, the given consent includes processing data for the purpose of order fulfillment, including transferring them for processing to other entities with whom the data administrator has signed an agreement, to the extent necessary for order fulfillment. In the case of registered Clients, the consent also includes managing the Client Account. Giving consent to the processing of personal data is voluntary but necessary to complete the order. Upon separate consent by the Buyer, the provided personal data may be used for another purpose as specified in the expressed consent

Clients of the Store via the website www.clothesforcrews.com have the right to access and correct the information provided by them constituting personal data, as well as the right to request access to, correction, deletion, or restriction of processing of the information provided, the right to object to the processing, and the right to data portability. The Buyer also has the right to withdraw their consent at any time without affecting the lawfulness of processing based on the consent before its withdrawal, as well as the right to lodge a complaint with a supervisory authority

Hallera 18, may deprive the Client of the right to use the Online Store, as well as limit their access to part or all of the Store's resources, with immediate effect, in the event of the Client's violation of the Terms, especially if the Client:
- Provided untrue, inaccurate, or outdated information during registration, misleading or violating the rights of third parties
- Engaged in behavior through the Online Store that violates the personal rights of third parties, particularly the personal rights of other Store clients
- Engaged in other behavior deemed by UBIERAMYEKIPY DAMIAN TABACZUK based in Katowice, address: 40-321 Katowice, ul. Hallera 18, to be inconsistent with applicable law or general principles of Internet use, or harmful to the good name of UBIERAMYEKIPY DAMIAN TABACZUK

In the interest of the security of our Clients' data, any observations will be promptly verified to ensure the highest level of protection for the processed data
Information regarding the automatic processing of data by the website www.clothesforcrews.com is included in the Privacy Policy.
IV. Procedure for Concluding the Sales Agreement and Order Fulfillment
To conclude a Sales Agreement via the Online Store, the Client must visit the website www.clothesforcrews.com, select the product, its brand, color, and size, following subsequent technical steps based on the prompts displayed to the Client and the information available on the site
The selection of the Goods ordered by the Client is made by adding them to the cart
During the process of placing an Order – until the "Place Order" button is pressed – the Client has the possibility to modify the provided data and the selection of Goods. To do this, the Client should follow the prompts and information available on the site
After providing all necessary data, a summary of the placed order will be displayed. The order summary will include information about:
- The subject of the order
- Unit and total price of the ordered products and delivery costs
- Selected payment method
- Selected delivery method

To send the Order, it is necessary to accept the content of the Terms, provide personal data marked as mandatory, and click the "Order, to pay" button
If the Client has given consent, as mentioned in point 3.9 letter a), within 14 days from the date of placing the order, they will receive an email with a request to provide feedback on the purchased product and/or transaction made at Clothesforcrews.com, which may be posted on the website
Sending an Order by the Client constitutes a declaration of intent to conclude a sales contract with UBIERAMYEKIPY DAMIAN TABACZUK based in Katowice, address: 40-321 Katowice, ul. Hallera 18, in accordance with the content of the Terms
The Sales Agreement is concluded in the Polish language, with content consistent with the Terms
Promotions do not combine with each other. Only one discount code can be used per order
1. Purchase of Goods as Intra-Community Supply of Goods within the EU for VAT-Identified Taxpayers
When is an activity/transaction considered an intra-Community supply of goods? An activity is considered an intra-Community supply of goods if all the following conditions are met:
- The goods are exported from the country, understood as the territory of the Republic of Poland, and are intended to perform activities defined in Article 7 of the VAT Act in the territory of a Member State other than Poland
- The transaction was made to a contractor who is a VAT taxpayer identified for intra-Community transactions in the EU
Who is a contractor in intra-Community transactions?
The contractor is a VAT taxpayer identified for intra-Community transactions in the EU (i.e., has a valid EU VAT number) or is a legal or natural person who is not a VAT taxpayer but is identified for intra-Community transactions in the EU (i.e., has a valid EU VAT number)
To complete an intra-Community supply of goods in our store, please select "Company" in the ordering data, choose the destination country for delivery, and select the option "I am an EU VAT taxpayer. I am ordering without VAT and will settle it in my country."
After successful verification of the contractor's data, including the EU VAT number, we will issue an invoice with a 0% VAT rate in accordance with regulations.
V. Delivery
- Delivery of Goods is made to the countries listed on the website to the address indicated by the Client during the order placement
- Delivery of ordered goods is carried out by Inpost courier service only within the territory of the Republic of Poland. The delivery costs are detailed on the website. Outside of Poland, delivery is carried out by Poczta Polska
- The delivery time is between 2 to 7 business days from the date of dispatch of the Order by the Client. The delivery time for international shipments is between 7 to 14 business days
- Clients can access these Terms at any time via the link provided on the main page of the www.clothesforcrews.com website and download or print it. Recording, securing, sharing, and confirming the essential provisions of the Sales Agreement of Goods takes place by sending the Client an electronic invoice to the provided email address, as defined in Article 2 point 32 of the VAT Act
VI. Prices and Payment Methods

The prices of Goods are given in Polish zlotys (PLN) and include all components, including VAT (with indication of the rate), customs duties, and any other charges

The Client has the option to pay by:

- Payment via Przelewy24 or PayPal

Orders with cash on delivery (COD) payment are possible only for amounts up to 5000 PLN (1250 euro), with a prior deposit payment for the order
VII. Right to Withdraw from the Contract
- You have the right to withdraw from this contract within 14 days without giving any reason.
- Personalized orders are not subject to the right of withdrawal. A personalized order also includes an order for products made to measure in our store, and products made to order are clearly described in the product description and visible to the client before placing the order.
The withdrawal period expires after 14 days from the day on which you acquired the goods or a third party, other than the carrier and indicated by you, acquired the goods.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email).

- Group orders placed via the website or email, which are tailored by us and for which the waiting time is longer than 5 days, cannot be canceled during the production process once production has started.
- Clothing that is not available on the website and is a modification of our models, or an individual customer order, cannot be returned, as is the case for clothing with custom prints requested by the customer; such items are also non-refundable and non-exchangeable.
Effects of Withdrawal from the Contract
In the event of withdrawal from this contract, we will reimburse you for the value of all returned products without delay, and in any case no later than 14 days from the day on which we are informed of your decision to exercise the right of withdrawal from this contract. We may withhold the reimbursement until we have received the goods back or until you have provided evidence of having sent back the goods, whichever occurs first.
Please send or deliver the item to: UBIERAMYEKIPY DAMIAN TABACZUK, Hallera 18, 40-321 Katowice, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send the item back before the 14-day period has expired.
You will have to bear the direct cost of returning the goods. If the withdrawal occurs after an electronic invoice has been issued, the buyer will receive a corrective electronic invoice, which they agree to.

UBIERAMYEKIPY DAMIAN TABACZUK, based in Katowice, address: Hallera 18, 40-321 Katowice, is committed to processing every complaint within 14 days, and if this is not possible, to inform the Client within this period when the complaint will be processed.
- If the complaint is acknowledged after issuing an electronic invoice, the buyer will receive a corrective electronic invoice, which they agree to.
2. Complaints Regarding the Provision of Electronic Services
- UBIERAMYEKIPY DAMIAN TABACZUK, based in Katowice, address: Hallera 18, 40-321 Katowice, undertakes actions to ensure the correct operation of the Store, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by Clients within a reasonable time.
- The Client is obliged to immediately notify UBIERAMYEKIPY DAMIAN TABACZUK, based in Katowice, address: Hallera 18, 40-321 Katowice, of any irregularities or interruptions in the functioning of the Online Store service.

- The complaint should include the Client’s name, correspondence address, the type, and date of the irregularity related to the functioning of the Store.

VIII. Final Provisions

Copying, modifying, sharing, publishing, and using them for sales purposes is prohibited and subject to criminal penalties. UBIERAMYEKIPY DAMIAN TABACZUK, based in Katowice, address: Hallera 18, 40-321 Katowice, does not permit their use, distribution, or dissemination without written consent under penalty of claims for copyright infringement and intellectual property theft.

In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Act on Providing Electronic Services, and other relevant provisions of Polish law shall apply.
